RE: The tariff classification of air horn kits from an unspecified country

Dear Mr. Engelmann,

In your letter dated December 6, 2010, you requested a tariff classification ruling.

The items under consideration have been identified as four (4) complete Air Horn Kits (#’s H02109A, H02009A, H00977N and H00984) for installation on large commercial trucks. All the Kits are similar with the exception of the length of the horn projector (trumpet-shaped part of the air horn). Each Kit contains a 12-volt electric compressor and air tank for use in applications where the air horn kit is “stand alone” [requiring only a 12-volt power supply to operate (does not operate off of the vehicle air supply system)]. The Kits come complete with all of the following components:

Air horn with projector Air compressor Air storage tank Solenoid valve for release of air pressure to operate horn Pressure switch to start/stop the compressor to regulate air pressure in storage tank Air pressure gauge Electrical wiring to connect compressor to power supply and controls Plastic tubing for transport of air supply within system Brass fittings to connect system together All necessary mounting hardware and fasteners

The applicable classification subheading for the Air Horn Kits (#’s H02109A, H02009A, H00977N and H00984) will be 8512.30.0020, Harmonized Tariff Schedule of the United States (HTSUS), which provides for “Electrical … signaling equipment … of a kind used for … motor vehicles … : Sound signaling equipment: Horns.” The rate of duty will be 2.5%.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
